Terms of Service
1. Acceptance of Terms
By accessing endeavour-investments.com or any related pre-launch marketing pages for the forthcoming Endeavour mobile application (collectively, the “Services”), you (“you”, “User”) agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Services.
2. Eligibility
You must be:
At least 13 years old (or the minimum digital-consent age in your jurisdiction, whichever is higher); and
Legally capable of forming a binding contract under applicable law.
3. Permitted Use
You may use the Services solely for lawful, personal or internal business purposes. You must not:
copy, scrape, or reverse-engineer any part of the Services;
disrupt or interfere with security-related features;
upload malware, unsolicited marketing, or unlawful content;
impersonate Endeavour staff or misrepresent your affiliation.
4. Intellectual Property
All content, trademarks, and software on the Services are owned by Endeavour Investments Inc. or its licensors and protected by Canadian and international IP laws. No rights are granted except as expressly stated in these Terms.
5. User Content
If you submit or post any information (e.g., contact-form entries, comments), you grant Endeavour a world-wide, royalty-free, sub-licensable, transferable licence to use, store, and display that content for the purpose for which it was supplied. You warrant that you have all rights necessary to grant this licence.
6. Third-Party Links & Services
The Services may contain links to third-party sites or integrate third-party tools. Endeavour is not responsible for the content, security, or privacy practices of those third parties; your use is at your own risk.
7. Disclaimer of Warranties
The Services are provided “as is” and “as available.” To the maximum extent permitted by law, Endeavour disclaims all warranties—express, implied, statutory or otherwise—including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Security measures reduce risk but do not guarantee absolute security.
8. Limitation of Liability
To the fullest extent permitted by law, Endeavour and its directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising out of or in connection with your use of (or inability to use) the Services—even if advised of the possibility. Endeavour’s total cumulative liability for all claims in any 12-month period will not exceed CAD $100.
9. Indemnification
You agree to indemnify and hold harmless Endeavour, its affiliates, officers, and employees from any claim, demand, loss, or damage (including legal fees) arising out of (i) your breach of these Terms, (ii) your misuse of the Services, or (iii) your violation of any law or the rights of a third party.
10. Modifications to the Services
Endeavour may modify, suspend, or discontinue the Services (or any part) at any time without liability. We may update these Terms; material changes will be posted at least 15 days before taking effect. Continued use after changes means acceptance of the revised Terms.
11. Termination
Endeavour may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we reasonably believe violates these Terms or is otherwise harmful. Sections 4, 6 – 9, 12 – 14 survive termination.
12. Governing Law & Venue
These Terms are governed by the laws of British Columbia, Canada, without regard to conflict-of-laws principles. Any disputes will be resolved exclusively in the provincial or federal courts located in Vancouver, BC, unless mandatory law provides otherwise.
13. Export & Sanctions Compliance
You may not use, export, or re-export the Services except as authorised by Canadian law and the laws of the jurisdiction in which the Services were obtained. You represent you are not on any Canadian, US, or other applicable government sanctions list.
14. Entire Agreement & Severability
These Terms constitute the entire agreement between you and Endeavour regarding the Services and supersede all prior communications. If any provision is held unenforceable, the remaining provisions remain in effect.
